Biography

Phillip J. Henry is experienced in the following areas of litigation: personal injury, medical malpractice, breach of fiduciary duty litigation, consumer protection litigation, business disputes and domestic relations. He also practices in real estate and corporate law.  Phil is an aggressive litigator who stands up for his clients to make sure that their rights are protected.  Phil will personally assists his clients to understand the relevant claims and defenses involved in their litigation and will make recommendations as to what options are in their best interest.  Phil also assists his clients’ with setting up and operating their businesses and assists them in real estate transactions.

Phil has lived in Berea with his wife JoAnn since 1999.  They have 3 adult children.  In his spare time Phil likes spending time with his family, camping, biking and axe throwing.

Experience Overview

  • Personal Injury Litigation: Phil helps clients recover their damages relating to injuries caused by others.  These injuries are typically caused by a negligent driver or the owner of a vicious dog.  Phil assists clients in pursuing and recovering damages relating to injuries, pain and suffering and lost wages resulting from their injuries.  Phil will assist an injured client to collect the medical records and bills relating to their injury and will build the case to maximize the client’s recovery.  Phil will aggressively pursue recover of the damages resulting from the client’s injuries.
  • Consumer Litigation: Phil helps clients who have been taken advantage of by contractors through unfair or deceptive acts and practices.  Phil assists clients in building their case and pursuing claims under the Ohio Consumer Sales Practices Act (“CSPA”) against the contractor.  Phil will aggressively pursue recovery of the client’s damages under the CSPA, which allows consumers to recover up to three times their actual damages and attorney’s fees incurred in pursuing their claim against the contractor.
  • Breach of Fiduciary Duty Litigation: Phil helps clients recover damages caused by  individuals who have breached their fiduciary duties as agent under a power of attorney or as trustee of a trust.  Phil assists clients in pursuing claims against these individuals who have abused their authority and violated their duties under the power of attorney or trust.  Phil assists the client in obtaining all of the documents relating to all financial transactions entered into by the individual while serving as a fiduciary under the power of attorney or will.  Phil assists the client to understand the full extent of their damages and to aggressively pursue recovery of the damages caused by the individual’s breach of their fiduciary duties.
  • Medical Malpractice: Phil helps clients recover their damages caused by the medical malpractice.  Phil assists clients with obtaining all relevant records and bills to build the case and maximize the client’s recovery.  Phil works with the client and medical experts to aggressively pursue recover the client’s damages caused by the medical malpractice.
  • Business Disputes: Phil helps business owners recover their damages caused by an owner or officer’s abuse their powers to personally benefit themselves financially.  Phil assists the business owner in obtaining all relevant financial records to confirm the individual’s breach of their statutory duties and to determine the full extent of the damages caused by their breach.  Phil aggressively pursues recovery of damages caused by the individual’s breach of their duties to the owner and the business.
  • Domestic Relations: Phil helps people to terminate their marriages through divorce and dissolutions.  Phil works with clients to obtain all relevant documents necessary to equitably divide the marital assets.  Phil assists clients in protecting their separate property and working towards an equitable division of marital property.  Phil works with clients to develop a parenting plan which is in their child’s best interests and assists clients in calculating child support and maximizing any potential spousal support award.
  • Real Estate: Phil assists individuals and businesses who are looking to buy or sell commercial real estate.  Phil works with clients to draft a purchase agreement which achieves their goals and protects their interest in the transaction.  Phil assists the client through the entire real estate transaction.  Phil also assists landlords with drafting a leases for their property and in pursuing evictions of tenants who have breached their lease.
  • Corporate: Phil helps individuals set up and operate their businesses.  Phil assists individuals by working with the client’s accountant to determine the proper business structure for them.  Phil assists clients with filing the new business’ Articles with the Secretary of State and prepares the Operational Documents.  Whether its an Operating Agreement for a Limited Liability Company or Regulations for a Corporation, Phil will work with the client to draft documents which allows the business to properly function and which allows the business to grow.  Phil works with the client to make sure they understand the proper procedures to ensure that the business is properly operated and their personal assets are protected.
